A class-wide settlement has been reached in a lawsuit about whether certain alleged gift cards included in FabFitFun seasonal boxes from parties such as Merrithew International Inc., Zumba Fitness, LLC, Physique 57 International Inc. and Reeds Jewelers, Inc. d/b/a The Jeweler's Wife (the “Vendors”), included an expiration date that violates certain state and federal gift card laws.  FabFitFun and the Vendors deny all of the claims in the lawsuit, but have agreed to a settlement to avoid the cost and risk of a trial.

Your Legal Rights and Options:

Submit a Claim: The only way to receive a replacement gift card under the Settlement is to submit a Claim Form no later than October 6, 2017. The Claim Form can be found under "SUBMIT CLAIM" or other options for submission can be found in the "Long Form Notice" under "DOCUMENTS".

Exclude Yourself: You have the right to exclude yourself from the settlement by sending a written request for exclusion. If you do so, you will not be entitled to any benefits under the Settlement.

Object: You have the right to tell the Court if you have an objection to the Settlement. You can do this only if you don’t exclude yourself. 

Go To The Hearing: You have the right to ask to speak in Court about the fairness of the Settlement. You can do this only if you don’t exclude yourself and if you submit a written objection to the Settlement with the Court on or before October 6, 2017. The date of the hearing for final approval of the settlement is October 27, 2017.

Do Nothing: If you do nothing, you will remain in the Class. You will be bound by the settlement.
